Your HR Checklist for Q1 2023

Now that the year-end duties are behind us, the new year brings new reporting requirements and deadlines for important HR compliance related tasks that employers need to take care of. To assist in your Q1 compliance, The O’Connor Group has put together a checklist to highlight some of the more noteworthy tasks related to HR, benefits, payroll, and compliance issues.
Filing W-2’s – January 31, 2023
- By January 31st, employers must provide Form W-2 to employees (paper or electronic). A copy of each employee’s W-2 must also be sent to the Social Security Administration (same deadline).
- Generally, your payroll provider handles both the employee filing and Social Security Administration filing.
- Now is the time to verify that you have the correct address for active employees and former employees that were employed in 2022.
Independent Contractor Form 1099-NEC – January 31, 2023
A 1099-NEC form is used to report independent contractor pay information if the contractor earned more than $600 in 2022. The NEC (non-employee compensation) form replaces the former 1099-MISC for reporting independent contractor pay.
OSHA Form 300A – March 2, 2023
Applicable employers with 10 or more employees are required to file a completed Occupational Safety and Health Administration OSHA Form 300A. This form is used for employers to record all reportable injuries and illnesses that occur in the workplace for the previous calendar year.
Affordable Care Act (ACA) Reporting – Varying Dates
The responsibility for affordable healthcare coverage is on the employer, and the reporting requirements depend on the number of full-time equivalent employees (FTEs). Applicable Large Employers (ALE – defined as an average of 50 full-time employees or more) must complete the following:
- Furnish Form 1095-C to applicable employees by March 2, 2023.
- The deadline for filing paper Forms 1094-C and 1095-C with the IRS is Feb. 28, 2023, or March 31, 2023, if filing electronically (employers with 250 or more forms to file must do so electronically).
